BY ORDERING CREDIPER SOFTWARE, YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS (THE "AGREEMENT") GOVERNING YOUR USE OF CREDIPER'S SERVICES AND SOFTWARE, (COLLECTIVELY, THE "SERVICE"). IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MAY NOT USE THE SERVICE.
Welcome
As part of the Service, Crediper will provide you with end user software. Your registration for, or use of, the Service shall be deemed to be your agreement to abide by this Agreement including any materials available on the Crediper web site incorporated by reference herein, including but not limited to Crediper's privacy and security policies.
In addition, we offer a 14-day free trial with no further obligation. Please see our web site for feature differences between the various editions and for additional details on this free trial.
We agree to provide you access to The Site in accordance with the Terms of Use.
Account Terms
You must be at least 18 years old to use this Service. You must provide your full legal name, a valid email address, and any other required information to complete the sign-up process. You are responsible for maintaining the privacy and security of your account. Crediper will not be held liable for any damage or loss that may result from your failure to protect your login information, including your password. Each person/entity may not maintain more than one account.
YOUR ACCESS TO AND USE OF THE SITE MAY BE TERMINATED AT ANY TIME FOR ANY REASON OR FOR NO REASON BY YOU OR BY US.
You accept that The Site is provided on an "as is, as available" basis.
WE MAY, SUBJECT TO AND IN ACCORDANCE WITH OUR PRIVACY POLICY FOR MARKETING AND OTHER PURPOSES, COLLECT, PROCESS AND TRANSMIT CERTAIN DATA OBTAINED FROM AND ABOUT YOU IN THE COURSE OF YOUR ACCESSING THE SITE. BY AGREEING TO THESE TERMS YOU AGREE TO SUCH DATA BEING SO USED AND FURTHER AGREE THAT IT MAY BE TRANSMITTED TO OTHERS WHETHER OR NOT WITHIN THE UNITED STATES IN ACCORDANCE WITH OUR PRIVACY POLICY AND UNDER APPLICABLE PRIVACY AND DATA PROTECTION LEGISLATION. Information on how and what type of data (if any) is held about you can be obtained by clicking the Privacy Policy link or by contacting us.
The Site, any information provided from it and the Terms of Use are given and made in the state of Florida, United States of America. THIS TERMS OF USE AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF FLORIDA, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS TERMS OF USE AGREEMENT SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN BROWARD COUNTY IN THE STATE OF FLORIDA.
Payment and Access
If you initially sign up for a free trial account, your credit card will not be charged unless you agree to extend the Service beyond the 14th day of that month. You will only have to pay for shipping & handling of the software. After your free trial has ended, Crediper will will offer you a non-refundable one time payment to re-activate your software for life time usage, with NO monthly fees, UNLIMITED access, and UNLIMITED disputes.
Your Responsibilities
You are responsible for all activity occurring under your User accounts and shall abide by all applicable local, state, national and foreign laws, treaties and regulations in connection with your use of the Service, including those related to data privacy, international communications (e.g., import/export laws and regulations) and the transmission of technical, personal or consumer information or data.
Not a Credit Repair Service (Limitations)
Crediper is not a credit repair company. Crediper provides a software application that integrates letter templates and other functions that may be used for the purpose of providing credit repair. Crediper neither manages nor monitors this function, and you take sole responsibility for any credit repair operations you engage in while using the Service as well as responsibility for disclosures and all other restrictions imposed on credit repair organizations by federal and state law. You, as a User of the Crediper Service, maintain sole control and responsibility for any use of the Service or letters or tools contained therein, mailing of letters or other correspondence, management, monitoring, and other functions related to credit repair services you offer or perform for consumers or for yourself, and Crediper makes no representations, guarantees, promises or other claims that such letters or application will result in any particular outcome as no one can control the credit bureaus' or other furnishers' response to a letter. You may use the Service to operate a credit repair business to challenge credit items identified as inaccurate, misleading, or unverifiable, but the Service does not perform or provide any negotiations of credit filings or contest facts or engage in or advise on any litigation or similar process. No consumer and no "credit repair" company or credit repair organization has the right to have accurate, current, and verifiable information removed from a consumer's credit report.
Our letters reference information about the law. But legal information is not the same as legal advice -- the application of law to an individual's specific circumstances. We recommend you consult a lawyer if you want professional assurance of the letters, and your interpretation of it, and as appropriate to your particular situation.
DISCLOSURES TO CONSUMERS REQUIRED BY FEDERAL LAW
The following disclosure is required by federal law to be provided to consumers by credit repair organizations before any contract or agreement between the consumer and the credit repair organization is executed:
Consumer Credit File Rights Under State and Federal Law
You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor any "credit repair" company or credit repair organization has the right to have accurate, current, and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over 7 years old. Bankruptcy information can be reported for 10 years.
You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days. The credit bureau must provide someone to help you interpret the information in your credit file. You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud.
You have a right to sue a credit repair organization that violates the Credit Repair Organization Act. This law prohibits deceptive practices by credit repair organizations.
You have the right to cancel your contract with any credit repair organization for any reason within 3 business days from the date you signed it.
Credit bureaus are required to follow reasonable procedures to ensure that the information they report is accurate. However, mistakes may occur.
You may, on your own, notify a credit bureau in writing that you dispute the accuracy of information in your credit file. The credit bureau must then reinvestigate and modify or remove inaccurate or incomplete information. The credit bureau may not charge any fee for this service. Any pertinent information and copies of all documents you have concerning an error should be given to the credit bureau.
If the credit bureau's reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the credit bureau, to be kept in your file, explaining why you think the record is inaccurate. The credit bureau must include a summary of your statement about disputed information with any report it issues about you.
The Federal Trade Commission regulates credit bureaus and credit repair organizations.

The following must be provided by the credit repair organization to consumers as a document, which is separate from any written contract or other agreement between them or any other written material provided to the consumer:
Retention of Compliance Records
(1) In general--The credit repair organization shall maintain a copy of the statement signed by the consumer acknowledging receipt of the statement.
(2) Maintenance for 2 years--The copy of any consumer's statement shall be maintained in the organization's files for 2 years after the date on which the statement is signed by the consumer.

Representations & Warranties
Each party represents and warrants that it has the legal power and authority to enter into this Agreement. Crediper represents and warrants that it will provide the Service in a manner consistent with general industry standards reasonably applicable to the provision thereof and that the Service will perform substantially in accordance with the online Crediper Help documentation under normal use and circumstances subject to the Disclaimer of Warranties and other limitations stated in this Agreement. You represent and warrant that you have not falsely identified yourself nor provided any false information to gain access to the Service and that your billing information is correct.
Disclaimer of Warranties
CREDIPER AND ITS LICENSORS MAKE NO REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, TRUTH, AVAILABILITY, ACCURACY OR COMPLETENESS OF THE SERVICE OR ANY CONTENT. CREDIPER AND ITS LICENSORS DO NOT REPRESENT OR WARRANT THAT (A) THE USE OF THE SERVICE WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE OR OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM OR DATA, (B) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (C) ANY STORED DATA WILL BE ACCURATE OR RELIABLE, (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (E) ERRORS OR DEFECTS WILL BE CORRECTED, OR (F) THE SERVICE OR THE SERVER(S) THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SERVICE AND ALL CONTENT IS PROVIDED TO YOU STRICTLY ON AN "AS IS" BASIS. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD PARTY RIGHTS, ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW BY CREDIPER AND ITS LICENSORS.
Mutual Indemnification & Mutual Limitation of Liability
You shall indemnify, release, and hold Crediper, its licensors and each such party's parent organizations, subsidiaries, affiliates, officers, directors, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees, expenses, and costs) arising out of or in connection with: (i) a claim alleging that use of the Customer Data infringes the rights of, or has caused harm to, a third party; (ii) a claim, which if true, would constitute a violation by you of your representations and warranties; or (iii) a claim arising from the breach by you or your Users of this Agreement, provided in any such case that Crediper (a) gives written notice of the claim promptly to you; (b) gives you control of the defense and settlement of the claim (provided that you may not settle or defend any claim unless you unconditionally release Crediper of all liability and such settlement does not affect Crediper's business or Service); (c) provides to you all available information and assistance; and (d) has not compromised or settled such claim. Crediper shall have no indemnification obligation, and you shall indemnify Crediper pursuant to this Agreement, for claims arising from any infringement arising from the combination of the Service with any of your products, service, hardware or business process(s).
Modification to Terms
Crediper reserves the right to modify the terms and conditions of this Agreement or its policies relating to the Service at any time, effective upon posting of an updated version of this Agreement on the Service. You are responsible for regularly reviewing this Agreement. Continued use of the Service after any such changes shall constitute your consent to such changes.
Third Party Interactions
During use of the Service, you may enter into correspondence with, purchase goods and/or services from, or participate in promotions of advertisers or sponsors showing their goods and/or services through the Service. Any such activity, and any terms, conditions, warranties or representations associated with such activity, is solely between you and the applicable third-party. Crediper and its licensors shall have no liability, obligation or responsibility for any such correspondence, purchase or promotion between you and any such third-party. Crediper does not endorse any sites on the Internet that are linked through the Service. Crediper provides these links to you only as a matter of convenience, and in no event shall Crediper or its licensors be responsible for any content, products, or other materials on or available from such sites. Crediper provides the Service to you pursuant to the terms and conditions of this Agreement. You recognize, however, that certain third-party providers of ancillary software, hardware or services may require your agreement to additional or different license or other terms prior to your use of or access to their software, hardware or services.
